Visiting Canada

You may be looking to visit Canada for its boundless beauty and diversity, or to meet up with family or friends. No matter the reason, Canada welcomes you.

Canada is a spectacularly beautiful country, spanning over nine million square kilometers and six time zones, between the Atlantic and Pacific Oceans. It’s ethnic diversity, varied landscape, and four seasons make it a country well worth visiting. You may be looking to visit Canada for its boundless beauty and diversity, or to meet up with family or friends. No matter the reason, Canada welcomes you.

The process to enter is fairly straight forward, but requirements vary on where you are coming from, your age, and admissibility.

STUDYING IN Canada

As an RCIC, my main passion is in the area of bringing students — be it from elementary, secondary or university levels — to Canada. Drawing on 25 years of experience in the education system and in boarding of international students, I am exceptionally well versed in all aspects of what is required from foreign students to study in Canada, including acquisition of a Temporary Resident Visa or an eTA, to applying for a Study Permit. Beginning with paper applications, I progressed to on-line forms as IRCC evolved, and grew in my knowledge alongside Immigration Canada.

I am confident in my ability to advise and process what is needed, be it from entering to attend a six-month English proficiency program, to how to apply for a temporary work permit upon completion of a post-secondary degree. I have also become skilled on documentation required for travel, be it to the United States or simply to enter and return periodically from a home country.

WORKING TEMPORARILY

Many foreign nationals come to Canada for a limited period, not just to visit, but to work temporarily. Various programs are available, such as:

  • High skilled occupations in management, professional, scientific, technical or skilled trades
  • Caregivers of children, seniors or persons with medical needs
  • Agricultural workers
  • Labourers, food counter attendants, sales and service personnel

Temporary work permits are also available for students enrolled in a Canadian university or college, during studies but also as Post-graduate Work Permits.

Another very popular program is International Experience Canada. This reciprocal program is available to young people between the ages of 18 and 30, from various countries worldwide, providing the opportunity to visit Canada for one year but also work on an Open Work Permit anywhere in the country. Unlike other categories which require an LMIA (Labour Market Impact Assessment), employment does not need to be obtained before entry to Canada. An excellent opportunity for youth to visit, make money and gain experience while doing so, but also to get a feel for the country if considering immigration to Canada.

PERMANENT RESIDENCY

Canada is a country with a large land mass, vast resources, stable political system, and a universal health care system, all features which entice people from other countries. Combined with the fact that Canada has an aging population so needs immigrants to sustain its way of life, it is a win-win proposition for foreign nationals to settle in Canada permanently.

Permanent entry is based on three pillars:

  • Family reunification
  • Economic
  • Refugee and Humanitarian & Compassionate

Canada recognizes the need to keep families together, so provides the means for existing permanent residents and Canadian citizens to sponsor loved ones from other countries.

To increase the Canadian workforce and sustain the aging population, the Express Entry system was created to facilitate the quick entry of professionals and skilled workers. Prospective immigrants can apply federally through this system, or go through the Provincial Nominee Program, requirements which vary province to province.

As part of the United Nations Refugee Convention, Canada provides a home to refugees who have fled from persecution in their home countries, plus refuge to persons in need of protection, based on humanitarian and compassionate grounds.

Once Permanent Residency status is obtained, however, immigrants are expected to be part of society and be resident within the country for two years out of every five.

The process for obtaining Permanent Residency can be quite lengthy and depending on the path of application, extremely complicated, so unless the applicant has done in-depth research and feels quite confident in his or her ability to navigate the system, it is highly recommended that an immigration professional be consulted.

BUSINESS IMMIGRATION

Business immigrants are selected primarily on their ability to create jobs for themselves and other Canadians. Applications are assessed on the business and financial background, evaluating the soundness of business plans and validity of the applicant’s acquisition of wealth.

Immigrants wishing to enter Canada as self-employed are also welcomed, but must have the intention and ability to make significant contribution to specified economic activities in Canada.

And finally, the Start-up Visa Program is intended to link immigrant entrepreneurs with private Canadian angel investor groups or venture capital fund organizations that have experience working with startups and can provide essential resources. Applicants do not have to invest their own money but must adhere to strict regulations.

CITIZENSHIP

Canadian citizenship comprises three categories:

  1. Jus Sol – at birth, in Canada, a person is automatically a citizen
  2. Jus Sanguinis – based on blood ties, a person is automatically granted citizenship if at least one parent is a Canadian citizen
  3. Naturalization – becoming a citizen if first obtaining Permanent Resident status

An applicant with Permanent Resident status must meet the residency requirements, be at least 18 years old if not on the parental application, and demonstrate an understanding of the responsibilities of citizenship and pass a citizen test. The residency requirements are cumulative and can be complicated, depending on the applicant’s history as a Permanent Resident.

FAMILY SPONSORSHIP

As part of the family reunification pillar, the following can be sponsored:

  • Parents, grandparents, and their dependent children
  • Spouse, common-law, dependent children
  • Brothers, sisters, nephews, grandchildren under 18 and orphaned
  • Adopted children
  • A relative, if the sponsor is alone in Canada with no other relatives as above

Spousal relationships can include a spouse, common-law partner, or conjugal partners. Due to abuse in past years, officers very carefully examine the validly of relationships, taking into account previous sponsorships, documentation of co-habitation, plus various other factors. Before applying to sponsor, an applicant must be sure to have thorough documentation — sometimes including affidavits — to prove the relationship.

REFUGEES

As a member of the Refugee and Humanitarian Resettlement Program, Canada accepts a large number of refugees yearly. Some are sponsor-referred — friends, relatives, churches, communities — while others are brought in through the visa offices abroad. By definition, refugees have a well-founded fear of persecution due to race, religion, nationality, membership in a social category (ie. sexual orientation), or political opinion and are offered no protection in their home country.

Asylum seekers differ in that they might face similar circumstances in their home country but have voluntarily left and come directly to the Canadian border to seek refuge and protection.

Immigration consultants and lawyers are often employed to help these distressed people make their way through a complex system, and to represent them if decisions need to be appealed.
